Jackson v. State

District Court of Appeal of Florida, First District
Sep 4, 2001
795 So. 2d 159 (Fla. Dist. Ct. App. 2001)

Opinion

Case No. 1D00-3042

Opinion filed September 4, 2001.

An appeal from the Circuit Court for Duval County. Michael R. Weatherby, Judge.

Nancy A. Daniels, Public Defender; Glenna Joyce Reeves, Assistant Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Attorney General; Alan R. Dakan, Assistant Attorney General, Tallahassee, for appellee.

Appellant raises two issues on appeal. We find no merit as to the jury instruction issue. The constitutional challenge to the 10/20/Life statute on the basis of separation of powers has previously been rejected by this court in Green v. State, No. 1D00-4639 (Fla. 1st DCA Aug. 27, 2001). We affirm.

WOLF, KAHN and BENTON, JJ., concur.
