Jackson v. State

SUPREME COURT OF THE STATE OF DELAWARE
Jul 16, 2013
72 A.3d 501 (Del. 2013)

Opinion

No. 238 2013.

2013-07-16

Reginald D. JACKSON, Defendant Below, Appellant, v. STATE of Delaware, Plaintiff Below, Appellee.

Court Below—Superior Court of the State of Delaware, in and for New Castle County, Cr. ID 9801007022.
Before HOLLAND, JACOBS, and RIDGELY, Justices.

ORDER

JACK B. JACOBS, Justice.

This 16th day of July 2013, after careful consideration of the opening brief, the motion to affirm, and the record on appeal, we find it manifest that the judgment below should be affirmed on the basis of the Superior Court's decision, dated April 16, 2013, dismissing appellant's fourth, untimely and repetitive motion for postconviction relief. The Superior Court did not err in concluding that appellant had failed to assert a colorable claim of a miscarriage of justice sufficient to overcome the procedural hurdles.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
