ORDER ADOPTING REPORT AND RECOMMENDATION

ROBERT BRYAN, UNITED STATES DISTRICT JUDGE

Having reviewed the Report and Recommendation of the Honorable Brian A. Tsuchida, United States Magistrate Judge, any objections or responses to that, and the remaining record, the Court finds and ORDERS:

(1) The Court ADOPTS the Report and Recommendation.
(2) Petitioner's motion to amend his federal habeas petition (Dkt. 63) is DENIED.
(3) Petitioner's motions for extension of time (Dkts. 63, 67) are GRANTED IN PART. Petitioner shall file his response to Respondent's answer by September 20, 2021.
(4) The Clerk is directed to re-note the federal habeas petition to October 1, 2021.
(5) The Clerk is directed to send copies of this Order to the parties and to Judge Tsuchida.
