Original Mandamus Proceeding

This proceeding arises out of Cause No. 16616B, styled Roy Watters v. Mike Lopez and Tiffany Liesmann, pending in the 198th Judicial District Court, Kerr County, Texas, the Honorable M. Rex Emerson presiding.

ORDER

Sitting: Marialyn Barnard, Justice Luz Elena D. Chapa, Justice Irene Rios, Justice

On May 22, 2018, relator filed a petition for writ of mandamus asserting the trial court abused its discretion by granting a bill of review filed by the real parties in interest. Relator also filed a motion for emergency stay, asking this court to stay a dismissal hearing to be conducted by the trial court on May 30, 2018, at which time the trial court would consider whether the underlying lawsuit should be dismissed for want of prosecution. Relator also asks us to stay any scheduling order the trial court may issue. On May 24, 2018, we denied relator's motion for emergency stay and ordered relator to file with this court a copy of any order or ruling issued by the trial court following the May 30, 2018 hearing. On May 31, 2018, relator filed a copy of the trial court's order dismissing the cause for want of prosecution.

Relator is hereby ORDERED to show cause, no later than June 11 , 2018 , why the petition for writ of mandamus should not be dismissed now that there is a final judgment from which an appeal may be taken.

It is so ORDERED on June 1, 2018.
