Original Proceeding on Petition for Writ of Mandamus
MEMORANDUM OPINION
Relator filed a petition for writ of mandamus, challenging the trial court's refusal to rule on relator's motion to compel. Relator also sought emergency relief to stay proceedings in the trial court.
The underlying case is Rankin Road, Inc. v. Underwriters at Lloyds of London, Gulf Coast Claims Service, Pat Donovan, and John Andres, cause number 2010-25885, pending in the 165th District Court of Harris County, Texas, the Honorable Ursula Hall presiding.
On March 15, 2018, real party in interest filed a response, enclosing a copy of an order signed by the trial court ruling on relator's motion to compel. On March 21, 2018, this Court issued an order, directing relator to file a response by March 23, 2018, advising this Court whether the proceeding was moot. On March 23, 2018, relator filed a motion to dismiss, agreeing that the original proceeding was moot.
Accordingly, we grant relator's motion and dismiss the petition. Any pending motions are also dismissed as moot.
PER CURIAM Panel consists of Justices Bland, Lloyd, and Caughey.
