IN RE PATRICK ROUGHNEEN, M.D., CHERIE ROUGHNEEN, AND PATRICK T. ROUGHNEEN, M.D., P.A., Relators

Original Proceeding from the 298th Judicial District Court Dallas County, Texas Trial Court Cause No. DC-16-14053

Burns, Chief Justice Molberg, Justice and Breedlove, Justice.

ORDER

KEN MOLBERG, JUSTICE

Before the Court is relators' February 22, 2024 amended petition for writ of mandamus. In their petition, relators challenge the trial court's failure to rule on several motions.

It has come to the Court's attention that the trial court may have granted relators some or all the relief they seek in the pending mandamus proceeding. Accordingly, it appears that some or all of the issues in this mandamus proceeding may have become moot. See Elec. Reliability Council of Tex., Inc. v. Panda Power Generation Infrastructure Fund, LLC, 619 S.W.3d 628, 634-35 (Tex. 2021) (orig. proceeding) (discussing mootness doctrine). We lack jurisdiction over a moot proceeding. See id.

Accordingly, we direct relators to file, no later than April 18, 2024, a letter brief specifying which issues, if any, remain pending in this mandamus proceeding.

To the extent any issues remain, we REQUEST A RESPONSE to the petition addressing the remaining issues. The deadline for filing a response, if any, is April 25, 2024.
