PRETRIAL ORDER NO. 100 (Certain Motions for Summary Judgment)
1. In view of the withdrawal of the claims of the plaintiffs in all of the above-listed cases save 01 Civ. 2535, the defendants' motions for summary judgment therein [docket items 593, 607, 605, 602, 609 and 598] all are denied as moot.
2. Defendants' motion for summary judgment dismissing 01 Civ. 2535 (LAK) [docket item 613] is granted without opposition. The papers before the Court establish, among other things, that plaintiff's decedent had liver disease that already had progressed to cirrhosis before her treatment with Rezulin began. Accordingly, she cannot establish proximate cause. The case is dismissed.
