It is hereby ordered that the opinion filed herein on October 22, 2009, be modified as follows:

On pages 5-6 of the opinion, replace the citation to People v. Wagner with the following citation: In re Jody R. (1990) 218 Cal.App.3d 1615, 1621-1622.

This modification does not effect a change in the judgment.
