Opinion

No. 05-04-01566-CV.

Opinion issued November 4, 2004.

Original Proceeding from the County Court at Law No. 4, Dallas County, Texas, Trial Court Cause No. 03-10064-D.

Writ of Mandamus Denied.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Relator contends the trial judge erred in granting a motion for partial summary judgment and denying a motion to disqualify opposing counsel. Based on the record presented, we conclude relator has failed to show trial judge abused his discretion in granting the motion for partial summary judgment and denying the motion to disqualify opposing counsel. Accordingly, relator's motion for emergency stay and petition for writ of mandamus are DENIED. See Tex.R.App.P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-842 (Tex. 1992) (orig. proceeding).
