ORDER MODIFYING OPINION, NO CHANGE IN JUDGMENT

THE COURT:

It is ordered that the opinion filed herein on December 2, 2004 (124 Cal.App.4th 698;___Cal.Rptr.3d___), be modified as follows:

On page 3, the second sentence of the second paragraph [124 Cal.App.4th 702, advance report, par. 1], the word "conviction" is changed to "arrest" so that the sentence reads:

His criminal history included a 1980 felony conviction for driving under the influence and a 1995 arrest for spousal abuse involving Lenore.

There is no change in the judgment.
