Original Proceeding on Petition for Writ of Mandamus.

The respondent is the Honorable Mark Davidson of the 11th District Court of Harris County. The underlying suit is Johanna Turbi de Angustia, Individually and as Representative of the Estate of Ruben Dario Angustia, Ramon Matias Angustia, and Cristina Feliz v. Hanover Compressor Co., Hanover-PGN Compressor, C.A. and Thomas A. Clayton Consultants, Inc., No. 2004-57456 (11th Dist. Ct., Harris County, Tex.).

Panel consists of Justices TAFT, HIGLEY, and BLAND.


MEMORANDUM OPINION


The parties have filed a joint motion to dismiss relator's petition for writ of mandamus. No opinion has issued. Accordingly, the motion is granted, and the mandamus is dismissed. Our order, dated December 2, 2005, staying proceedings in the lower court is withdrawn as moot. All other pending motions are overruled as moot.
