Opinion delivered and filed March 30, 2005. DO NOT PUBLISH.

Original Proceeding. Petition struck.

Tyrone Johnson, Beeville, TX, Pro Se. Roy Defriend, Limestone County Attorney, Groesbeck, TX, for Appellee/Respondent.

Before Chief Justice GRAY, Justice VANCE, and Justice REYNA.

MEMORANDUM OPINION

Tyrone Johnson seeks a writ of mandamus from this Court directing Respondent, the Honorable H.D. Black, Jr., Judge of the 77th District Court of Limestone County, to issue a writ of habeas corpus. However, the Clerk of this Court notified Johnson that his mandamus petition is defective because "the certificate of service does not reflect that [he] served a copy of the petition on the respondent or the real party in interest." See TEX. R. APP. P. 9.5. The Clerk warned Johnson that his petition may be struck if he failed to serve these parties and notify this Court that he had done so within 20 days. Id. 9.4(i). Johnson has failed to respond. Accordingly, the petition is struck.
