ORIGINAL PROCEEDING WRIT OF MANDAMUS 270th District Court Harris County, Texas Trial Court Cause No. 2021-24324
Panel consists of Justices Jewell, Poissant, and Wilson.
ORDER
PER CURIAM
On September 11, 2023, relators C&J Well Services, Inc.; C&J Well Services, Inc. d/b/a C&J Energy Services; C&J Energy Services, Inc.; Nextier Oilfield Solutions, Inc. f/k/a C&J Energy Services, Inc.; Nextier Completion Solutions, Inc.; Basic Energy Services, Inc., et al. filed a petition for writ of mandamus in this Court. See Tex. Gov't Code Ann. § 22.221; see also Tex.R.App.P. 52. In the petition, relator asks this Court to compel the Honorable Dedra Davis, presiding judge of the 270th District Court of Harris County, to vacate the trial court's August 29, 2023 order quashing the hearings on relators' motions for summary judgment, and order the trial court to rule on relators' motions for summary judgment prior to trial. The real party in interest, Roger Cole, has filed a response the petition for writ of mandamus, and relators have filed their reply.
On November 13, 2023, relators filed a motion for temporary relief, requesting a stay of the underlying trial proceedings. According to relators, trial is preferentially set for November 27, 2023.
It appears from the facts stated in the petition and motion that relators' request for relief requires further consideration and that relators will be prejudiced unless immediate temporary relief is granted. We therefore GRANT relators' motion and issue the following order:
We ORDER the underlying trial proceedings in trial court cause number 2021-24324, Roger Cole v. C&J Well Services, Inc.; C&J Well Services, Inc. d/b/a C&J Energy Services; C&J Energy Services, Inc.; Nextier Oilfield Solutions, Inc. f/k/a C&J Energy Services, Inc.; Nextier Completion Solutions, Inc.; Basic Energy Services, Inc., et al, STAYED until a final decision by this court on relators' petition for writ of mandamus, or until further order of this Court.
