In the Matter of Michael Charles Cascio, An Attorney At Law (Attorney No. 048421991)


ORDER

The Disciplinary Review Board having filed with the Court its decision in DRB 20-238, concluding that Michael Charles Cascio of Marlton, who was admitted to the bar of this State in 1992, should be censured for violating RPC 1.1 (a) (gross neglect), RPC 1.3 (lack of diligence), RPC 1.4 (b) (failure to keep client reasonably informed about the status of a matter and to comply with reasonable requests for information), RPC 3.3 (a) (1) (false statement of material fact to a tribunal), RPC 3.4 (c) (knowingly disobeying an obligation under the rules of a tribunal), RPC 3.4 (d) (failure to comply with reasonable discovery requests), RPC 4.1 (a) (1) (false statement of fact or law to a third person), RPC 8.4 (c) (conduct involving dishonesty, fraud, deceit, or misrepresentation), and RPC 8.4 (d) (conduct prejudicial to the administration of justice);

And the Disciplinary Review Board having determined that respondent should be required to attend psychological counseling and provide proof of fitness to practice law and to provide quarterly reports documenting his continued psychological counseling to the Office of Attorney Ethics for a period of two years;

And good cause appearing;

It is ORDERED that Michael Charles Cascio is hereby censured; and it is further

ORDERED that respondent attend psychological counseling and provide proof of the attendance and fitness to practice law as attested to by a mental health professional approved by the Office of Attorney Ethics within sixty days after the filing date of this Order; and it is further

ORDERED that respondent provide to the Office of Attorney Ethics quarterly reports documenting his continued psychological counseling for a period of two years and until the further Order of the Court; and it is further

ORDERED that the entire record of this matter be made a permanent part of respondent's file as an attorney at law of this State; and it is further

ORDERED that respondent reimburse the Disciplinary Oversight Committee for appropriate administrative costs and actual expenses incurred in the prosecution of this matter, as provided in Rule 1:20-17.
