ORDER GRANTING PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT AND DENYING DEFENDANT'S CROSS-MOTION FOR SUMMARY JUDGMENT


In conjunction with the Court's Memorandum of Decision, of even date, on Plaintiff's Motion for Summary Judgment (doc. # 87) and Defendant's Cross-Motion for Summary Judgment (doc. #96),

IT IS HEREBY ORDERED that the Plaintiff's Motion for Summary Judgment is GRANTED. Pursuant to 11 U.S.C. § 523(a)(8), the Court finds that the excepting of the subject loans from discharge will impose an undue hardship on the Plaintiff-Debtor. Therefore, the subject loans are hereby discharged.

As that phrase is defined in the Court's Memorandum of Decision.

IT IS FURTHER ORDERED that the Defendant's Cross-Motion for Summary Judgment is DENIED.

SO ORDERED.
