No. 05-05-01623-CV (Tex. App. Oct. 3, 2006)

Opinion

No. 05-05-01623-CV

October 3, 2006.

On Appeal from the 193rd Judicial District, Dallas County, Texas, Trial Court Cause No. DV-03-11012-L.

Dismissed.

Before Chief Justice THOMAS and Justices LANG and MAZZANT.

MEMORANDUM OPINION

On December 2, 2005, appellants filed a notice of appeal in the above case. On March 23, 2006, we received a letter from the court reporter stating appellants had not paid for the record. On that same day, we sent a letter directing appellants to file, within ten days, written verification that they had paid for or made arrangements to pay for the record. When appellants had not filed written verification of their payment as of August 3, 2006, we ordered the appeal submitted without the reporter's record, and we ordered appellants to file their brief within thirty days or the appeal would be dismissed. Nevertheless, to date, appellants have not filed their brief nor otherwise communicated with this Court regarding their appeal.

Accordingly, we DISMISS the appeal. See Tex.R.App.P. 42.3(c).
