Howie v. Village of Mount Prospect

Appellate Court of Illinois, First District
Nov 4, 1940
307 Ill. App. 238 (Ill. App. Ct. 1940)

Opinion

Gen. No. 41,213. (Abstract of Decision.)

Opinion filed November 4, 1940

PLEADING, § 125.8cross-complaint, sufficiency. In action by bond-holder against village for an accounting of money alleged to have been collected on certain special assessments, where village filed cross-complaint making village treasurer and his sureties parties on ground treasurer had misapplied the collections, such cross-complaint was properly dismissed for failure to contain a plain and concise statement of the complaint, merely making the general allegation that an accounting would determine the liability of each of the sureties.
