Appellate Division of the Supreme Court of New York, Second Department
Jun 26, 1967
28 A.D.2d 719 (N.Y. App. Div. 1967)

Opinion

June 26, 1967

Order of the Supreme Court, Suffolk County, dated October 26, 1966, reversed, with $10 costs and disbursements, and plaintiff's motion for summary judgment denied. In our opinion, the papers in opposition to plaintiff's motion raised genuine triable issues of fact. Brennan, Acting P.J., Rabin, Hopkins, Benjamin and Munder, JJ., concur.
