Dec 13, 1974
304 So. 2d 670 (La. 1974)

Opinion

No. 55583.

December 13, 1974.

IN RE: GEORGE A. HEFT, APPLYING FOR CERTIORARI, OR WRIT OF REVIEW, TO THE COURT OF APPEAL, FOURTH CIRCUIT, PARISH OF ORLEANS.

Writ denied. No error of law.

BARHAM, J., is of opinion the petition for libel states a cause of action. See Fontenot v. Fontenot, 235 La. 488, 104 So.2d 431 and Mundy v. Gentilly Oaks, 227 La. 118, 78 So.2d 530 (1955).

TATE, J., is of the opinion that the Court of Appeal opinion herein is in conflict with the decisions cited by Mr. Justice Barham.
