Supreme Court of Florida
Sep 29, 2010
Case No. SC10-1280 (Fla. Sep. 29, 2010)

Opinion

Case No. SC10-1280.

September 29, 2010.

Lower Tribunal No(s). 1D98-2473, 96-6983CFA.

Because petitioner has failed to show a clear legal right to a recall of the mandate issued on June 30, 1999, by the First District Court of Appeal in Case No. 1D98-2473, he is not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000).

PARIENTE, LEWIS, QUINCE, LABARGA, and PERRY, JJ., concur.
