FORECLOSURE OF MORTGAGES, § 324right to damages for wrongful suing out of injunction restraining sale on redemption. Order of trial court, denying petition for damages for suing out, by holder of master's certificate of sale and another, of injunction restraining sheriff's sale on redemption from foreclosure sale by holder of judgment notes against mortgagors, decree in which injunction suit was reversed on appeal and remanded, affirmed in part and reversed in part and cause remanded with directions.

Appeal from Circuit Court of Lake county; Hon. RALPH J. DADY, presiding.

Affirmed in part, reversed in part, and remanded with directions. Heard in ths court at October term, 1942.
