ORDER TO SHOW CAUSE

On January 31, 2024, counsel for respondent filed a Motion to Dismiss for Lack of Prosecution. This case was called from the calendar of the Court's February 26, 2024, New York City, New York trial session. There was no appearance by or on behalf of petitioner. Counsel for respondent appeared and was heard. Upon due consideration and for cause more fully appearing in the transcript of the proceeding, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is taken under advisement. It is further

ORDERED that, on or before March 18, 2024, petitioner shall show cause in writing why respondent's Motion to Dismiss for Lack of Prosecution should not be granted and a decision entered in this case. Failure to respond to this order will likely result in the granting of respondent's motion and entry of decision against petitioner. It is further

ORDERED that jurisdiction is retained by the undersigned.
