This case was originally calendared for trial at the Trial Session of the Court scheduled to commence on April 3, 2023, in Atlanta, Georgia. By Order of the Court dated March 21, 2023, this case was continued and jurisdiction was retained by this Division of the Court.

On December 14, 2023, petitioner filed with the Court a Status Report. Petitioner informed the Court that it was recently discovered that there is a pending filed Amended Return for the taxable year at issue, but that counsel for petitioner has requested and is awaiting a copy of the Amended Return. On December 14, 2023, respondent filed with the Court a Status Report. Respondent informed the Court that he reached out to petitioner's counsel on December 12, 2023, and, as of the filing of his status report, had not received a response.

On January 25, 2024, the Court held an informal conference call with the parties. The parties informed the Court that they are trying to craft decision language that negates the amended return but still reflects the file amended return.

For cause, it is

ORDERED that, on or before March 1, 2024, the parties shall file with the Court a further status report informing the Court of the then-present of this case.
