REPORT AND RECOMMENDATION


Defendant Ayers Village Condominium Assoc. appeared under a power of attorney provided to its President, a non-lawyer. By order of May 27, 2004, Ayers was advised that it was not permitted to appear pro se but must be represented by counsel. Ayers was given until June 25, 2004 to appear by counsel. Document no. 9. The time for appearance by counsel was extended first to July 9 (Document no. 15) and then to July 14 (Document no. 16).

For the reasons set forth in the order of May 27, 2004 (Document no. 10), I recommend that the answer and appearance of Ayers Village Condominium Association be struck and a default be entered against it.

Any objections to this Report and Recommendation must be filed within ten (10) days of receipt of this notice. Failure to file objections within the specified time waives the right to appeal the district court's order. See Unauthorized Practice of Law Comm. v. Gordon, 979 F.2d 11, 13-14 (1st Cir. 1992);United States v. Valencia-Copete, 792 F.2d 4, 6 (1st Cir. 1986).
