SUPPLEMENTAL DECISION


Per P.B. § 64-1(a) and § 6-1, the Court further amends and refines its decision of June 20, 2006 regarding the May 30, 2006 (#102) Motion to Dismiss of the defendant, Secretary of State, Susan Bysiewicz and the Motion to Dismiss, dated June 1, 2006 (#103), of the co-defendant, R.S. Silver Enterprises, Inc.

The Court specifically adopts the recital of facts and legal reasoning set out in the Memorandum of Law dated May 30, 2006, of the Secretary of State, as per the attached. This Court grants the Motion to Dismiss of the Secretary of State because of the lack of subject matter jurisdiction.

The Court specifically adopts the recital of facts and legal reasoning set out in the Memorandum of Authority in Support of Motion to Dismiss, filed by the co-defendant, R.S. Silver Enterprises, Inc. as per the attached. The Court grants the Motion to Dismiss of the co-defendant, R.S. Silver Enterprises, Inc. because the plaintiffs lack standing to seek a writ of mandamus directing the Secretary of State to revoke the reinstatement of R.S. Silver Co., Inc., a/k/a R.S. Silver Enterprises, Inc.
