ORDER


On June 11, 2008, this court held a telephonic hearing on defendant's emergency motion to consolidate the above-captioned cases and extend the schedule on the first-filed case. See Dkt. 364 in Case No. 07-cv-273-bbc and Dkt. 3 in Case No. 08-cv-298-bbc.

After hearing from both sides and for reasons stated on the record, I denied both parts of these motions. The first-filed case will continue to trial as scheduled. In consultation with counsel, I set the schedule for the second-filed case.

The parties also fronted with the court other procedural and substantive concerns regarding discovery, motions practice and so forth; at this juncture, the court remains in response mode awaiting motions or other submissions from the parties as they deem appropriate.
