ORDER ADOPTING REPORT AND RECOMMENDATION

BENJAMIN H. SETTLE UNITED STATES DISTRICT JUDGE

The Court, having reviewed the Report and Recommendation of Magistrate Judge Grady J. Leupold, objections to the Report and Recommendation, if any, and the remaining record, does hereby find and ORDER:

(1) The Court adopts the Report and Recommendation.

(2) Petitioner's federal habeas Petition, which is second or successive, is dismissed without prejudice for lack of jurisdiction.

(3) Petitioner's IFP Motion (Dkt. 1) and all Proposed Motions and Requests (Dkts. 1-3, 1-5, 1-6, 4, 5, 6, 7, 8) are denied as moot.

(4) A certificate of appealability is denied in this case.

(5) The Clerk is directed to send copies of this Order to Petitioner and to the Hon. Grady J. Leupold.
