Supreme Court of Alabama
Jun 12, 1924
100 So. 855 (Ala. 1924)

Opinion

1 Div. 263.

June 12, 1924.

Appeal from Circuit Court, Clarke County; Ben D. Turner, Judge.

J. F. Thompson, of Birmingham, and Ray Rushton and James J. Mayfield, both of Montgomery, for appellant.

Wm. Cunninghame, of Linden, Mulkey Mulkey, of Geneva, and Stevens, McCorvey, McLeod Goode, of Mobile, for appellee.

The announcements contained in Coma Garrett, Jr., v. James G. Cuninghame (Ala. Sup.) 100 So. 845, are to the effect that the circuit judge committed error in rulings on demurrer to answer and special pleas indicated in that opinion, and in granting the writ.

Ante, p. 430.

The two cases are submitted together. However, this judgment is reversed and one here entered declining the writ.

Appellee is taxed with the costs of this appeal.

Reversed and rendered, writ denied, and petition dismissed.

ANDERSON, C. J., and SOMERVILLE and BOULDIN, JJ., concur.
