MEMORANDUM OF DECISION RE ORDER OF COMPLIANCE
The defendant has filed a request for an order of compliance claiming that the plaintiff's disclosure of experts was not in compliance with Practice Book § 13-4. This court agrees in part.
The reference by the plaintiff that he "intends to call as expert witnesses at trial any and all of the physicians and health care providers with whom the plaintiff has sought treatment, consultation or diagnosis for any medical condition" is not a disclosure at all. Further, the disclosure is an unstructured narration interjecting references to the specific physicians indicated in the report.
It is ordered that the plaintiff follow the form as required by Practice Book § 13-4 with respect to each individual expert expected to be called at trial. Catalano v. Falco, 74 Conn.App. 86 (2002). The Appellate Court allowed the disclosure to refer to the expert testifying substantially in accordance with his treatment notes and evaluation and consultation reports all of which had been provided to the defendant's counsel, but it did not approve of a deviation of the form and sub-paragraphs for each individual expert as required under Practice Book § 13-4.
