ORDER ACCEPTING FINDINGS, CONCLUSIONS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


After making an independent review of the pleadings, files and records in this case, and the Findings, Conclusions and Recommendation of the United States Magistrate Judge dated October 10, 2001, and the objections dated October 23, 2001, the Court finds that the Findings and Conclusions of the Magistrate Judge are correct and they are accepted as the Findings and Conclusions of the Court. Plaintiff is given leave to amend within thirty days of the date of this Order, solely to assert claims against Dallas County instead of "Dallas County Jail Medical Department" and directs the Clerk to prepare copies of the Amended Complaint and deliver them with the summons to the United States Marshal Service, who shall serve the Amended Complaint within thirty (30) days of receipt pursuant to FED. R. CIV. P. 4(c).

IT IS, THEREFORE, ORDERED that the Findings, Conclusions and Recommendation of the United States Magistrate Judge are accepted.

SO ORDERED
