Having considered the briefs filed by the parties, this Court has determined that the report of the referee should be approved in full. Accordingly, Warner Barker Miller, III, is hereby disbarred from the practice of law in the State of Florida effective immediately.

Judgment is entered for The Florida Bar, 650 Apalachee Parkway, Tallahassee, Florida 32399, for recovery of costs from Warner Barker Miller, III, in the amount of $1,149.70, for which sum let execution issue.

No final until time expires to file motion for rehearing and, if filed, determined. The filing of a motion for rehearing shall not alter the effective date of this disbarment.
