ORDER

On November 13, 2023, appellant, Edward Festeryga, filed a Notice of Interlocutory Appeal from an order denying his Motion to Dismiss Pursuant to the Texas Citizens Participation Act signed on October 25, 2023.

The next day, appellant filed an Opposed Motion to Abate Appeal and Suspend Appellate Deadlines Pending Resolution of Federal Appeal. Appellee filed a response to the Motion and appellant replied.

Appellant's Motion to Abate is denied. Appellant's brief is due on January 17, 2024.

It is so ORDERED.
