The legal issue in this case is the same as that presented inState v. Property at 2018 Rainbow Drive known as the Oasis, 740 So.2d 1025 (Ala. 1999). The judgment of the Court of Civil Appeals is reversed and the cause is remanded, based on our holding in that case.

REVERSED AND REMANDED.
