ON APPLICATION FOR A WRIT OF HABEAS CORPUS CAUSE NO. F1723232-A IN THE 420TH DISTRICT COURT FROM NACOGDOCHES COUNTY

ORDER

PER CURIAM.

Applicant was convicted of capital murder and sentenced to life imprisonment. The Twelfth Court of Appeals affirmed his conviction. Butcher v. State, No. 12-18-00349-CR (Tex. App.-Tyler Oct. 31, 2019)(not designated for publication). Applicant filed this application for a writ of habeas corpus in the county of conviction, and the district clerk forwarded it to this Court. See Tex. Code Crim. Proc. art. 11.07.

The Court received this application on June 1, 2022. On June 15, 2022, the Court denied the application based on the trial court's findings and our own independent review of the record. The Court has now determined that the trial court's findings should not have been adopted. After reconsideration on its own motion, the Court withdraws its prior order denying this on both the trial court's findings and our own independent review of the record and enters an order denying this application based solely on the Court's independent review of the record.

Applicant's writ application is denied.
