MEMORANDUM OF DECISION RE DEFENDANT'S MOTION FOR MODIFICATION DATED 8/14/06, #128
The court heard the above-captioned matter on October 10, 2006 when the plaintiff appeared with counsel and the defendant appeared pro se. The parties' agreement, which was incorporated into the Judgment of December 2, 2005 included an alimony provision whereby the defendant had to pay the plaintiff the sum of $5,146.67 per month from his employment severance package. He testified that he no longer has income due to his unemployment and his testimony was not disputed. Counsel for the plaintiff suggested that the court enter orders in view of the defendant's unemployment. The court enters the following orders.
ORDERS
1. The defendant's motion is granted and alimony is reduced to $1 per year retroactive to September 26, 2006.
2. The defendant shall continue to seek employment or otherwise engage in income producing endeavors and shall send to plaintiff's counsel on a monthly basis his efforts in this regard.
3. If the defendant obtains employment or otherwise he shall immediately notify plaintiff's counsel and any modifications shall be retroactive to the date of such employment.
4. The defendant shall furnish the plaintiff's counsel copies of all documentation concerning reemployment including all matters in writing concerning said employment.
5. As tax information is received by the defendant for the calendar year 2006 he shall immediately send copies of such information to plaintiff's counsel.
6. The parties shall contact the Family Caseflow Coordinator to schedule a review date in mid-February 2007.
