We REINSTATE this appeal.

On July 24, 2023, this Court abated this appeal for the trial court to hold a hearing and make findings of fact and recommendations concerning appellant's counsel's failure to timely file appellant's brief. On August 14, 2023, the Court received appellant's brief. Accordingly, we ORDER the brief filed as of the date of this order. The State's brief is due THIRTY DAYS from the date of this order.

Additionally, we VACATE the order of July 24, 2023, and the trial court need not hold the hearing or make the findings and recommendations required by that order.

We DIRECT the Clerk to send copies of this order to the Honorable Casey Blair, Presiding Judge, 86th Judicial District Court, and to counsel for all parties.
