ORDER

This case for the redetermination of a deficiency was recalled from the calendar in Dallas, Texas, on September 9, 2024, for hearing on respondent's Motion to Dismiss for Lack of Prosecution, filed July 22, 2024. Petitioner and counsel for respondent appeared and announced that a basis of settlement had been agreed upon.

The terms of the settlement were read into the record, but additional time is necessary to allow for the preparation of computations that will reflect that settlement.

Premises considered, it is

ORDERED that respondent's motion is denied. It is further

ORDERED that jurisdiction in this case is retained by the undersigned. It is further

ORDERED that the parties submit a proposed stipulated decision not later than November 8, 2024.
