We affirm the dismissal of appellant's Rule 3.850 motion, except for the claim pursuant to Peart v. State, 756 So.2d 42 (Fla. 2000). We reverse the dismissal of that claim and remand for the trial court to either attach records refuting the claim or hold an evidentiary hearing.

AFFIRMED IN PART; REVERSED IN PART; REMANDED.
