This case is currently calendared on the Court's Cincinnati, Ohio trial session, scheduled to begin September 11, 2023.

On July 11, 2023, petitioner Mark Edward Dixon filed a motion for summary judgment. We directed the Commissioner to file a response to the motion for summary judgment and Mr. Dixon to file a reply to the Commissioner's response. Both parties filed their respective documents. It would be helpful to the Court to hear oral arguments from the parties on this motion. Therefore, we will set this motion for hearing at the above-referenced trial session. Accordingly, it is

ORDERED that Mr. Dixon's motion for summary judgment filed July 11, 2023, is set for hearing at the above-referenced trial session in Room 305, U.S. Courthouse, 100 East Fifth Street, Cincinnati, OH 45202. The parties are expected to appear at the call of the calendar at 10:00 a.m. (ET) on September 11, 2023, to be heard on the motion.
