In a report and recommendation filed February 25, 2003, Magistrate Judge Eaton recommended dismissal of the complaint on the ground that it is time barred. No objections have been filed although the time within which to do so has expired.

The motion is granted and the case dismissed for the reasons set forth in the report and recommendation and the memorandum and order dated January 27, 2003.
