WADE DAVIS and LYNN DAVIS, Respondents Below-Appellants v. DIVISION OF FAMILY SERVICES and COURT APPOINTED SPECIAL ADVOCATE, Petitioners Below-Appellees. No. 163, 2001 Supreme Court of the State of Delaware. Decided: October 19, 2001

Before WALSH, HOLLAND, and BERGER, Justices.

ORDER

This 19th day of October 2001, upon consideration of the briefs of the parties, we conclude that this appeal should be affirmed on the basis of, and for the reasons set forth in, the decision of the Family Court dated March 22, 2001. The record fully supports the Family Court's determination that the parents failed to plan for their children and that termination of their parental rights was in the children's best interest.

With respect to the appellants' claim of ineffective assistance of counsel, we find no basis in this record to conclude that trial counsel was ineffective or that appellants sustained any prejudice by reason of joint representation.

NOW, THEREFORE, IT IS ORDERED that the judgment of the Family Court be, and the same hereby is, AFFIRMED.
