ORDER

Douglas B. Shapiro Presiding Judge.

Appellants' motion to withdraw appeal on the ground of mootness is GRANTED.

This matter is REMANDED to the trial court for the purpose of determining whether appellants timely moved to withdraw their appeal after learning of the facts that rendered the appeal moot. If the trial court determines that appellants acted in an untimely manner without excuse, the court shall determine whether sanctions are appropriate. If the trial court determines that sanctions are appropriate, the court shall award plaintiff-appellee her costs and reasonable attorney fees expended as a consequence of appellants' delay, in an amount determined by the trial court.

This order has immediate effect. MCR 7.215(F)(2). This Court does not retain jurisdiction.
