Before the Court is Patrick Daugherty's appeal of the trial court's January 3, 2018 Order Granting Highland Capital Management, L.P.'s Motion for Sanctions. Daugherty filed this appeal on March 27, 2018, but had previously filed an original proceeding seeking relief from the same order through writ of mandamus, which is docketed as In re Patrick Daugherty, Cause No. 05-18-00290-CV. We have determined this appeal should be decided with the original proceeding because the order appealed from appears to be based on contempt findings subject to review through mandamus.
We, therefore, ORDER cause number 05-18-00329-CV CONSOLIDATED into cause number 05-18-00290-CV. We DIRECT the Clerk of the Court to remove all documents from cause number 05-18-00329-CV and refile them in cause number 05-18-00290-CV and to treat cause number 05-18-00329-CV as a closed case. We ORDER that all future pleadings be filed in and bear only cause number 05-18-00290-CV. Appellate briefing deadlines remain suspended.
