Granted. The order of the district court of April 16, 1985 is vacated and reversed, and the case is remanded to the district court pursuant to the judgment of this Court on original hearing.

DENNIS, J., concurs in the expeditious disposition of this application, being of the opinion that respondents may apply for rehearing and present arguments for setting aside this Court's judgment.

WATSON, J., dissents.
