Opinion
No. 35869.
April 19, 1967. Rehearing Denied May 24, 1967.
Writ of Certiorari to the District Court of Appeal, Third District, 189 So.2d 648.
Loewenstein, Dunn Johnson and Thomas A. Horkan, Jr., Miami, for petitioner.
Dixon, DeJarnette, Bradford, Williams, McKay Kimbrell and A.H. Toothman, Miami, for respondent.
The petition for writ of certiorari reflected probable jurisdiction in this Court. After argument and upon further consideration, we have determined the writ was improvidently issued. The writ must be and is discharged and the petition is dismissed.
It is so ordered.
THORNAL, C.J., and DREW, O'CONNELL, CALDWELL and ERVIN, JJ., concur.
