DECISION & ORDER ON MOTION
Appeal and cross appeal from an order of the Civil Court of the City of New York, Kings County, entered November 20, 2013. A review of the record indicates that appellant-respondent served a copy of the order appealed from, with notice of entry, and a copy of the notice of appeal, on December 11, 2013, and the notice of cross appeal was not filed until January 17, 2014.
On the court's own motion, it is
ORDERED that the cross appeal is dismissed as untimely (see CPLR 5513).
