Decisions Pursuant to Rule 1:28.

The judgments on the charges of aggravated rape and assault and battery are affirmed. The judgment on the charge of kidnapping is reversed and the verdict is set aside. The matter is remanded for resentencing on the charges of aggravated rape and assault and battery in accordance with the memorandum and order of the Appeals Court.
