Argued September 29, 1972. Before JONES, C. J., EAGEN, O'BRIEN, ROBERTS, POMEROY, NIX and MANDERINO, JJ.

Appeal, No. 95, March T., 1972, from decree of Commonwealth Court, No. 97 C.D. 1971, in case of Commonwealth ex rel. Mackey Raymond Choice v. Joseph R. Brierley, Superintendent of State Correctional Institution at Pittsburgh, and Pennsylvania Board of Probation and Parole. Decree reversed and case remanded to the Pennsylvania Board of Probation and Parole for counselled hearing on revocation of parole.

Habeas corpus.

Decree entered granting respondent's motion for summary judgment and denying petition, opinion per curiam. Relator appealed.

Decree reversed and case remanded to the Pennsylvania Board of Probation and Parole for a counselled hearing on the revocation of parole. See Com. ex rel. Rambeau v. Board of Probation and Parole, 4 Pa. Commw. 152 (1972).
