The order denying appellant's motion to dismiss is vacated and this cause remanded for an evidentiary hearing and a redetermination of the issues. See Clarkson v. Snyder, No. 99-311 (Fla. 5th DCA August 6, 1999).

REVERSED AND REMANDED.
