For the foregoing reasons, Claimant's motion for summary judgment as to liability on his wrongful confinement cause of action is granted and Defendant's Cross–Motion for summary judgment dismissing the Claim is hereby denied. Claimant's motion for summary judgment as to liability on his negligence cause of action is denied as moot.
